RECOGNITION OF ITALIAN CITIZENSHIP BY MARRIAGE


(Art. 5 Legge 5 febbraio 1992, n. 91)

The spouse of an Italian citizen can request the Italian citizenship after six months of marriage if resides in Italy or three years if the residence is outside of Italy. 

DOCUMENTS REQUIRED: 

1.    APPLICATION; 
2.    BIRTH CERTIFICATE - It must be "long form",  translated into Italian . It must bear the "Apostille" (according to Hague Convention of Dec. 5th, 1961). "Apostille" is the legalization provided by the Office of the Secretary of State of the State where the birth certificate is issued. Documents issued in Countries other than US must be translated into Italian and legalized by the Italian Authority (Consulate or Embassy) in the Country of origin; 
3.    MARRIAGE CERTIFICATE issued from the Comune of registration in Italy; 
4.    CERTIFICATE OF CITIZENSHIP  of the Italian spouse (it can be issued by this Office only if the Italian citizen is duly registered with the A.I.R.E. - "Anagrafe Italiani residenti all'estero"); 
5.    AFFIDAVIT OF FAMILY COMPOSITION  stating the applicant's family composition with personal  data (Applicant, Italian spouse, children); 
6.    POLICE RECORD issued by the Department of Justice of the State where you reside (in original with official seal) translated into Italian. Should you have legally resided in other locations outside this Jurisdiction, you need a criminal record for each State or Country. (All translated into Italian and legalized by the Italian Authority (Consulate of Embassy)  in the Country of origin; 
7.    FBI Clearance (Finger Print Form) from FBI-Criminal Justice Information, service division Attn. S.C.M.O.D. D2, 100 Custer Hollow Rd., Clarksburg, West Virginia 26306 Ph. (304) 624-6200 or (304) 625-2000, with translation into italian. 
8.    Copy of your passaport. 
9.    PAYMENT INSTRUCTIONS

On July 15, 2009 a new Law N.94, regarding citizenship, was enacted in Italy, which states that effective August 8, 2009, prior to presenting applications to request Italian citizenship through marriage or renunciation of Italian citizenship, you are required to make a wire transfer, directly to the Ministry of the Interior in the amount of 200 EUROS, using the following coordinates:

The receipt must indicate your maiden name, place and date of birth and reason for the transfer.

PLEASE NOTE THAT RECEIPT OF THE WIRE TRANSFER IS TO BE PRESENTED AT THE TIME OF THE APPLICATION, TOGETHER WITH ALL THE REQUIRED DOCUMENTS, AS INDICATED ON OUR WEBSITE.

There is a Consular fee to pay for each legalization provided by this Office. Such fee is subject to change every three months. Personal checks cannot be accepted. Incomplete applications (and/or documentation) cannot be taken into consideration.
